ABES presente em audiência pública da OAB sobre o Marco Regulatório do Saneamento

A Associação Brasileira de Engenharia Sanitária e Ambiental – ABES, representada por seu presidente, o Engenheiro Roberval Tavares de Souza, participou em Brasília, nesta quarta-feira, 28 de agosto, da audiência pública da Ordem dos Advogados do Brasil – OAB sobre o Marco Regulatório do Saneamento (assista aqui ao vídeo).

Roberval foi um dos palestrantes do segundo painel do evento, que teve também participação de Edson Carlos, do Trata Brasil, em mesa presidida por Leandro Frota, presidente da Comissão Especial de Saneamento e Recursos Hídricos da OAB Federal, e composta ainda pelos membros da OAB Fabio Basílio e Sergio Antunes. Também estiveram presentes o presidente da ABES-DF, Sérgio Gonçalves, e o diretor nacional para a Região Centro-Oeste, Mário Guerino. Em outros painéis participaram entidades como Aesbe, Assemae e Abcon.

Roberval saudou a iniciativa e ressaltou os esforços da ABES para criar um ambiente político e institucional na construção do Marco, a fim de que este contribua para a melhoria do saneamento no país. “A discussão é boa para o país exercitar a democracia e a construção do consenso. Somos favoráveis às mudanças no marco, precisamos melhorar, criar os instrumentos que possam tirar o país da segunda divisão do saneamento no mundo e este instrumento pode ser algo que conduza o Brasil para um novo caminho”, frisou Roberval.

O presidente da ABES apresentou o Ranking ABES da Universalização do Saneamento (veja aqui a edição 2019), mostrando que há bons exemplos de gestão tanto do setor público como do privado. “O setor quer a eficiência do saneamento, não uma guerra entre setores público e privado. Queremos a união dos dois para resolver o problema do saneamento, é o que defendemos na ABES”.

Roberval lembrou ainda que, no modelo atual, o Brasil prevê universalizar o saneamento em 2064 e que isso pode não se tornar realidade, se não houver consenso. “O grande desafio do relator da Comissão que analisa os vários Projetos de Lei será construir o consenso olhando todos os PLs e ouvindo o setor, para que o texto final contemple a grande maioria do saneamento”.

Ele ressaltou também os dois pontos de alerta, que a ABES vem questionando: as questões do fim do contrato programa (a ABES defende sua manutenção) e da alienação das ações.

“Temos que construir texto que garanta a entrada forte do privado – por meio de capital e operação –, mas o contrato programa é primordial para manter os serviços e mais uma opção para o titular dos serviços, que é o município, de acordo com a Constituição. Em relação à alienação, não podemos ter a venda das estatais para cobrir rombo dos estados, como ocorreu no Rio de Janeiro, com a Cedae”.

Roberval finalizou pontuando as premissas do Pacto Pelo Saneamento, documento que a ABES apresentou durante seu 30º Congresso Brasileiro de Engenharia Sanitária e Ambiental, realizado em junho em Natal/RN (leia mais aqui).

Veja a seguir as cinco premissas do pacto sugerido pela ABES:

– Fortalecimento da regulação por meio da Agência Nacional de Águas;

– Definição da titularidade conforme orientação do STF, municípios titulares e nas regiões metropolitanas, titularidade compartilhada;

–  Equidade entre as cláusulas dos contratos programa e contratos de concessão com estímulo a eficiência (metas e indicadores de desempenho para a universalização);

–  Aumento da participação do setor privado no Saneamento, em parceria com as empresas públicas, por meio de parcerias público privadas (PPPs), sociedades de propósito específico (SPEs), participação no capital social das empresas de economia mista, subdelegação, etc;

–  Estabelecimento de tarifa justa aos usuários dos serviços de saneamento, garantindo o acesso aos serviços com equilíbrio financeiro.
