Base de Remuneração Regulatória de serviços públicos de água e saneamento: o tratamento regulamentar das PPPs, contratos de desempenho e obras / contratos de serviços tradicionais

A Base Regulatória de Ativos (BRA), também conhecida como Base Regulatória de Remuneração (BRR), constitui uma parte relevante das tarifas das concessionárias de água e saneamento. Corresponde ao montante de investimentos prudentes feitos pelos prestadores de serviços que operam sob um regime de eficiência, que são reconhecidos pelo regulador para fins de composição da base tarifária após auditoria e inspeção periódicas, consolidadas nas revisões tarifárias. As principais abordagens utilizadas na regulamentação para determinar o valor da BRA nas Revisões Tarifárias são: i) financeiras: que buscam manter uma remuneração justa para o negócio; ii) física: que efetua a avaliação dos ativos a partir do custo técnico, cujas referências são os valores necessários para a aquisição e substituição dos ativos; e iii) composto por metodologias híbridas das duas primeiras. Os órgãos reguladores devem garantir um ambiente estável e confiável e uma estrutura de longo prazo para atrair investimentos em água e saneamento, de acordo com o planejamento estabelecido nos planos e contratos municipais. Esta sessão visa promover discussões sobre as melhores práticas em torno da formação da base de ativos regulatórios, considerando os diferentes tipos de compras disponíveis, como parcerias público-privadas (PPPs), contratos de desempenho e também contratos tradicionais de obras/ serviços. Temas como critérios de elegibilidade e prudência dos investimentos a serem feitos podem ser discutidos, trazendo experiências nacionais e internacionais sobre o tema.

Como a estrutura tarifária pode garantir o acesso universal aos serviços de água e saneamento (subsídios e tarifas sociais)

O mundo tem grandes desafios para alcançar o acesso universal ao abastecimento de água e infraestruturas de saneamento básico. Aproximadamente 2,2 bilhões de pessoas no mundo não possuem serviços de água gerenciados com segurança. No Brasil, existem cerca de 40 milhões de pessoas sem acesso à água potável e mais de 100 milhões de pessoas sem acesso à infraestrutura de esgoto. A vulnerabilidade e a baixa renda das populações da América Latina e do Caribe, associadas à existência de poucos estudos sobre métodos e conhecimentos para estabelecer tarifas e preços relacionados à água, dificultam o debate sobre esse assunto. Sem regras claras, a definição de tarifas pode apresentar assimetrias, aumentar o risco de que os preços aplicados sejam mais altos ou mais baixos do que seria possível, ou mesmo que subsídios direcionados (como tarifa social e limite de consumo) sejam inadequados. Assim, um instrumento com potencial para incentivar a universalização pode gerar distorções nas faixas de consumo e agravar a distância do acesso. O objetivo da sessão é discutir as possíveis estruturas tarifárias para o setor de água e esgoto viáveis do ponto de vista econômico e financeiro e que possam contribuir para a consecução do ODS 6. Haverá alternativas de estrutura tarifária e estratégias de subsídios para serviços de abastecimento de água e esgoto, considerando os modelos existentes de serviços de água (governamentais, privados, PPP). Ele também analisará qual seria a estrutura tarifária do saldo justo para acelerar o desenvolvimento da infraestrutura de água e esgoto e o papel das agências reguladoras para alcançar o ODS6.

No Brasil, existe uma separação legal entre as responsabilidades pelo gerenciamento e regulamentação do uso da água e a prestação de serviços públicos de saneamento, que incluem o abastecimento de água, às vezes relacionado a diferentes órgãos, bem como a diferentes níveis de jurisdição. Leis federais distintas tentam conciliar ações para preservar a qualidade e a quantidade de recursos hídricos em sua alocação. As duas regras legais estabelecem a necessidade de compatibilidade e integração entre o planejamento no nível da bacia hidrográfica e os municípios dentro dela. O que no plano legal e institucional seria bem concebido e estabelecido, pode de fato ser um desafio na prática da gestão de recursos hídricos e na prestação de serviços de abastecimento de água. Um exemplo é a redução de perdas reais. Esta não é uma ação de curto prazo e deve ser permanente. A análise do impacto regulatório deve preceder qualquer medida regulatória, verificar seu escopo e o resultado do problema a ser tratado e minimizar possíveis consequências negativas (ou efeitos colaterais), seja qual for o setor, e levará a medidas e recomendações de viabilidade verificadas, com prazos adequados para conformidade. A sessão pretende discutir esses e outros mecanismos, a serem adotados pelas agências reguladoras ou propostos e empregados pelos prestadores de serviços de saneamento, e que configuram as melhores práticas nacionais e internacionais.

Os subsídios atuais do setor de saneamento falham em alcançar seus objetivos devido à deficiência dos projetos, sendo muitas vezes difusos, caros, mal direcionados, não transparentes ou distorcidos. Esse desempenho ruim dos subsídios ao abastecimento de água e saneamento (WSS) pode ser evitado, com novos conhecimentos e tecnologias que possibilitam que esses subsídios sejam menos onerosos e mais eficazes. Além disso, a acessibilidade é uma importante preocupação transversal que afeta o direito humano ao saneamento. Por mais intuitivo que o conceito possa parecer, não há consenso sobre como a acessibilidade deve ser definida. Há análises limitadas desse conceito de acessibilidade, que distingue diferentes contextos – como urbano versus rural, ou famílias conectadas versus não conectadas. A preços baixos atuais, a demanda do consumidor por água para uso doméstico não responde muito bem às mudanças nas tarifas de água em muitos países. No entanto, a redução do consumo de água é crítica em regiões com escassez de água, onde as concessionárias experimentaram aumentos de tarifas sazonais, buscando reduzir a demanda em períodos de seca. À medida que as oportunidades para expandir o suprimento de água se tornam mais caras, será necessário dar uma ênfase maior ao gerenciamento da demanda. Esta sessão, nesse âmbito, discutirá como as tarifas de água, subsídios e abordagens de acessibilidade podem ajudar o Brasil a alcançar suas metas de universalização dos serviços de saneamento.

Dado o imenso déficit de acesso aos serviços de saneamento e os investimentos aquém do necessário para atingir as metas estabelecidas pelo PLANSAB, é necessário entender de que forma é possível somar esforços para mudar este quadro. Assim, faz-se pertinente buscar entender de que forma a atuação complementar dos setores público e privado pode ser mais efetiva. Para tal, é importante investigar: (i) como equalizar interesse social e retorno financeiro; (ii) se há algum nicho de atuação do setor púbico ou privado, (iii) quais são as possibilidades de parcerias entre os dois setores que sejam mais potentes do que sua atuação isolada. Ademais, é importante refletir sobre quais são as possibilidades e limites de atuação de cada um destes setores em um momento de crise como o atual, caracterizado por alto grau de incerteza e choques de oferta e demanda.
