Mais uma vez a ABES – Associação Brasileira de Engenharia Sanitária e Ambiental, é surpreendida por uma medida do Governo Federal que pode ser prejudicial ao setor de saneamento e vem, desta forma, expor sua preocupação e opinião sobre o que está posto no Decreto Federal nº 10.329 de 28 de abril de 2020, alterando o Decreto nº10.282 de 20 de março de 2020, que regulamenta a Lei nº13.979 de 06 de fevereiro de 2020.
Especificamente, a supressão dos incisos VIII e XIX do Art. 3º e a supressão do Art. 5º, podem colocar em risco as atividades de saneamento básico, na medida em que, desconsiderando a essencialidade desses serviços, os excluem das possibilidades de serem incluídos em medidas emergenciais e extraordinárias previstas na lei nº13.979/20.
Mesmo que se reconheçam as características local, regionalizada e estadual dos serviços, o momento atual exige que se reconheça que os serviços de saneamento sejam assumidos como essenciais para a saúde pública nacional, sendo racional que o Governo Federal, nesta hora, se coloque como apoio fundamental, se necessário, para que os serviços sejam mantidos e funcionem de modo regular, para todos cidadãos e cidadãs.
Deste modo, causa profunda estranheza observar que o novo Decreto Federal, parecendo querer de forma propositada ou equivocada, deixar os serviços de saneamento entregues às possibilidades limitadas de muitos Estados e Municípios brasileiros, exclui tais serviços da condição de “serviços públicos e as atividades essenciais”, conforme Decreto.
Assim, em nome não só da comunidade técnica e de seus associados, mas de milhões de brasileiros que necessitam de serviços de saneamento cada vez melhores, a ABES vem, respeitosamente, manifestar sua absoluta discordância do que está posto no Decreto Federal nº10.329/20, requerendo que se retorne à redação posta no Decreto Federal nº10.282 de 20 de março de 2020.
