Uma vez mais anuncia-se que o Congresso realizará a votação dos vetos do sr. Presidente da República à Lei 14.026, que altera o marco regulatório do setor de saneamento. A ABES – Associação Brasileira de Engenharia Sanitária e Ambiental volta a se manifestar para alertar sobre a importância de que os vetos sejam derrubados pelo Congresso Nacional, para evitar que uma transição radical e açodada leve à desorganização do setor e a retrocessos na prestação de serviços à população brasileira.
Recentemente, a realização de leilões de concessão e de PPPs, particularmente a licitação de concessão de serviços de abastecimento de água e esgotamento sanitário da Região Metropolitana de Maceió, tem trazido sérias preocupações aos profissionais de saneamento do país.
Uma primeira preocupação refere-se à qualidade das modelagens que embasam os processos. A licitação de modelagens por intermédio de pregões tem resultado em contratações com descontos escandalosamente altos, usualmente acima de 50%, inexequíveis para o cumprimento dos termos de referência propostos. A brutal redução de valor leva à virtual eliminação de serviços de engenharia com o grau de detalhe que seria necessário. A ausência de estudos de engenharia de qualidade e profundidade significa licitar-se sem o conhecimento adequado dos sistemas, o que aumenta os riscos e contraria o interesse público. Sem falar no risco adicional de estudos contratados por valores irreais poderem vir a ser capturados por interessados nos futuros leilões.
Outro problema, já insistentemente alertado, são modelagens que segregam áreas mais rentáveis e deixam em segundo plano outras, com sistemas de menor porte. Gera-se um elevado risco de acontecer o que já se experimentou no país, municípios menos rentáveis restarem a cargo do poder público, na dependência de escassos recursos fiscais.
Ainda mais grave são processos licitatórios que drenam recursos para fora do setor, que, deficitário, necessita que esses sejam retidos, para a ampliação do atendimento e busca da universalização da prestação de serviços. O resultado da licitação de Maceió, com uma vultosa outorga, que se explica pelas extremamente elevadas tarifas praticadas, provoca alarme nos profissionais do saneamento. Todos os recursos gerados deveriam obrigatoriamente permanecer no setor, o que também tem que ser aplicado a eventuais alienações de propriedade de empresas estatais, que a nova lei permite. O setor de saneamento não pode ser tratado como fonte de recursos para resolver déficits fiscais.
É importante ainda alertar que o resultado de um processo licitatório de concessão ou de PPP não significa que os objetivos pretendidos serão alcançados. É preciso evitar que propostas inexequíveis prevaleçam, o que levará a futuras renegociações, ou a impasses na execução dos contratos. O quanto menos embasadas tecnicamente sejam as contratações, mais será exigido do contratante na fiscalização e da regulação da prestação dos serviços. Contratação e regulação eficientes exigem preparo, e que os processos resultem de políticas públicas claras, particularmente na definição de como serão atendidos os que mais necessitam, os segmentos mais vulneráveis da população, moradores de áreas irregulares, de pequenas comunidades e de áreas rurais.
Após várias protelações, anuncia-se a votação dos vetos presidenciais para os próximos dias. A ABES reitera a importância de os senhores Congressistas manterem os acordos políticos firmados com a participação dos Governadores Estaduais, e rejeitarem os vetos, para permitir que uma transição ordenada e planejada possa ocorrer, buscando evitar os erros e distorções que a opção por mudanças bruscas e sem base técnica poderá trazer. Reiteramos que a adoção de soluções radicais trará enormes riscos de desorganização, impasses judiciais e retrocessos.
Pelo primado do interesse público e prioridade à busca da universalização da prestação de serviços de saneamento, a ABES chama à mobilização para a rejeição dos vetos à Lei 14.026/20.

Entendo que a ABES deve unir forças apresentando sugestões para que os contratos a serem licitados por concessão ou PPP sejam preparados para atender às colocações citadas na nota.
