Decreto do Governo Federal retira entidades do Conama

O presidente Jair Bolsonaro (PSL) assinou na quarta-feira, 28 de maio, decreto que reduziu de cerca de 100 para 23 o número de conselheiros titulares do Conselho Nacional do Meio Ambiente (Conama). A medida suprimiu a participação de representantes de todos os 26 governos estaduais e do Distrito Federal e de 21 entidades de trabalhadores e da sociedade civil, entre elas, a Associação Brasileira de Engenharia Sanitária e Ambiental – ABES.

Publicado nesta quarta em edição extraordinária do Diário Oficial da União, o decreto nº 9.806 também extinguiu a Câmara Especial Recursal, que era a instância do Conama responsável pelo julgamento, em caráter final, das multas e outras penalidades administrativas impostas pelo Ibama.
A representação de todos os ministérios e secretarias da Presidência da República e dos três comandos militares, estabelecida na composição anterior, também foi reduzida em consonância com a reforma ministerial recém implantada e inclui, além do Ministério do Meio Ambiente, a Casa Civil, a Secretaria de Governo e os ministérios da Economia, da Infraestrutura, do Desenvolvimento Regional, de Minas e Energia e da Agricultura, Pecuária e Abastecimento. Também não há mais representante da Agência Nacional de Águas (ANA) e houve redução das representações dos municípios.

Foram mantidas somente quatro representações para entidades ambientalistas, das doze que participavam da composição anterior, e duas das sete confederações empresariais nacionais a serem definidas entre a Indústria (CNI), o Comércio (CNC), a de Serviços (CNS), a de Agricultura (CNA) e a de Transporte (CNT).

A ABES ressalta a importância da participação da sociedade civil no Colegiado. “A composição do Conama vem sendo criticada desde sua composição inicial e também durante todas as reestruturações que passou em seus mais de 30 anos de existência. A ABES também tinha suas críticas a esta composição, sobretudo quanto ao desequilíbrio na composição dos setores do Conselho – onde havia uma sobrerrepresentação do Governo Federal e a uma sub-representação dos conselheiros do setor produtivo e das entidades de trabalhadores e da sociedade civil, porém, a representatividade de todos os segmentos deveria ser mantida, sem a exclusão de reconhecidas entidades técnico-científicas, de representantes sindicalistas e representantes das comunidades indígenas, importantes atores na preservação ambiental do país”, frisa a diretora nacional da ABES, Maria Lúcia Coelho Silva.

Para a ABES, a participação da sociedade civil deve atender ao definido na Constituição Federal de 1988, que consolida direitos do cidadão e prevê, em diversos dispositivos e leis, a participação dos cidadãos na formulação, implementação e controle social das políticas públicas.
