ABES promoverá discussão sobre desafios para comprovação da capacidade econômico-financeira dos prestadores de serviços com o novo marco legal

No dia 2 de agosto, próxima segunda-feira, às 10h, a ABES – Associação Brasileira de Engenharia Sanitária e Ambiental realizará o webinar especial “Novo Marco do Saneamento: desafios para comprovação da capacidade econômico-financeira dos prestadores de serviços”. O evento, que será transmitido por meio do canal da ABES no YouTube, contempla uma das mais importantes discussões do setor na atualidade. Inscreva-se aqui.

A moderação do debate será feita pelo presidente nacional da ABES, Alceu Guérios Bittencourt. Os debatedores convidados são: Samuel Moreira, deputado federal (PSDB/SP); Fernando Vernalha Guimarães, doutor e mestre em Direito do Estado; e Edson Silveira Sobrinho, Subsecretário de Regulação e Mercado Secretaria de Desenvolvimento da Infraestrutura do Ministério da Economia.

O evento faz parte do ABES Conecta, programa da ABES que disponibiliza conteúdo qualificado em webinares gratuitos e cursos pagos sobre os temas mais relevantes do setor de saneamento e meio ambiente. Já são mais de 270 mil visualizações nas transmissões.

Sobre os palestrantes:

Samuel Moreira tem uma atuação ativa na Câmara dos Deputados em prol das melhorias para o setor de saneamento básico. É autor do Projeto de Lei nº 2199/2021, que está em tramitação no Congresso Nacional e busca prorrogar prazos do novo marco regulatório do setor de saneamento. O texto do PL pretende alterar a Lei nº 11.445, para prorrogar o prazo exigido para inclusão das metas de universalização nos contratos de prestação dos serviços públicos de saneamento básico em vigor.

Nas justificativas presentes no texto do PL, Samuel Moreira enfatiza que “a prestação dos serviços públicos de saneamento básico não pode sofrer solução de continuidade, requerendo um ambiente de segurança jurídica para os contratos vigentes. Nesse sentido, faz-se necessário organizar minimamente uma compatibilização de prazos, de modo a permitir a operacionalização das adaptações determinadas na nova legislação, visando garantir que não sejam interrompidos os serviços e os investimentos, e que todas as mudanças tenham como prioridade o atendimento à população brasileira”.

Fernando Vernalha Guimarães é advogado e consultor na área do direito público, é fundador do Vernalha Pereira. Doutor e mestre em Direito do Estado, participou do programa visiting scholar na Columbia University Law School, em Nova Iorque (EUA). Vernalha possui vasta experiência na estruturação de projetos de concessão e parcerias público-privadas, bem como em processos de desestatização ou investimentos relacionados aos diferentes setores da infraestrutura. Ainda, o advogado é professor de pós-graduação em direito administrativo de diversas instituições. Em 2009, atuou como consultor da Unidade de Parceria Público-Privada do Ministério do Planejamento, Orçamento e Gestão.

Edson Silveira Sobrinho é PhD em Economia pela Universidade de Houston. Formado em Administração Pública (FJP) e Direito (UFMG), vem trabalhando com investimentos em infraestrutura há 17 anos, sendo desde 2005 como servidor público da carreira de finanças e controle do Tesouro Nacional. Está atualmente como Subsecretário de Regulação e Mercado na Secretaria de Desenvolvimento da Infraestrutura, abrangendo os setores de transportes, energia, telecomunicações e saneamento. Atuou diretamente no novo marco legal de saneamento, incluindo os decretos mais recentes e os estudos atualmente em elaboração no Ministério da Economia.
