Comissão do Saneamento Básico não chegou a consenso sobre o texto atual em discussão- Luis Macedo/Câmara dos Deputados

O relator da comissão especial que atualiza o marco legal do saneamento básico, deputado Geninho Zuliani (DEM-SP), vai apresentar na próxima terça-feira (29) novo parecer ao Projeto de Lei 3261/19, do senador Tasso Jereissati (PSDB-CE). O acordo entre os membros da comissão é votar a proposta no dia 30.

A versão anterior do parecer, apresentada no dia 9, é alvo de críticas não apenas de deputados da oposição, mas também de prefeitos e empresas estaduais e municipais de saneamento, que defendem texto alternativo apresentado pelo deputado Fernando Monteiro (PP-PE).

Na reunião da comissão desta quarta-feira (23), a possibilidade de privatização das companhias de saneamento continuou causando polêmica. A reunião foi tensa, com muita discussão entre os parlamentares.

Texto alternativo

Nota divulgada nesta quarta-feira (23) (clique aqui para ler) pela ABES – Associação Brasileira de Engenharia Sanitária e Ambiental,  Frente Nacional de Prefeitos, AESBE – Associação Brasileira das Empresas Estaduais de Saneamento e Assemae – Associação Nacional dos Serviços Municipais de Saneamento, entre outras, diz que o relatório de Zuliani trará insegurança jurídica e consequente desestruturação do setor saneamento básico, “ao eliminar a possibilidade de formalização de contratos de programa”.

Os chamados “contratos de programa” são firmados sem licitação e permitem aos municípios transferir a titularidade dos serviços de saneamento para empresas públicas estaduais de água e esgoto. O parecer de Zuliani prevê que os atuais contratos poderão ser mantidos até o prazo final, mas depois haverá licitação com a participação de empresas públicas e privadas para a recontratação dos serviços.

Os prefeitos e empresas estatais de saneamento rejeitam essa possibilidade e apoiam o voto em separado apresentado pelo deputado Fernando Monteiro. Diversos deputados da comissão especial que analisa o marco do saneamento também manifestaram apoio a essa proposta alternativa. “O meu texto prevê que a empresa, caso queira renovar o contrato de programa, demonstre a capacidade financeira a cada quatro anos. Se ela não demonstrar, ela não renova”,  explicou Fernando Monteiro.
