Com auditório lotado e público participativo, Debate ABES sobre a MP 868 reúne em São Paulo governo e entidades do saneamento

A ABES reuniu, nesta quinta, 28 de março, em São Paulo, governo federal e entidades do  saneamento em mais uma discussão histórica do setor para debater a  Medida Provisória 868/2018, que altera o marco legal do saneamento básico. Um público participativo e com diversos questionamentos sobre o assunto lotou o auditório do Conselho Regional de Química, na capital paulista, para um encontro que honrou mais uma vez a tradição da ABES de promover a democracia e a pluralidade, ao longo de seus quase 53 anos de trajetória trabalhando pelo saneamento ambiental, pela saúde e pela qualidade de vida das pessoas.

Integraram a discussão representantes da ANA – Agência Nacional de Águas, da Secretaria Nacional de Saneamento Ambiental, do Ministério do Desenvolvimento Regional e das entidades ABAR – Associação Brasileira das Agências de Regulação, ABCON – Associação Brasileira das Concessionárias Privadas de Serviços Públicos de Água e Esgoto, AESBE –Associação Brasileira das Empresas Estaduais de Saneamento, ASSEMAE – Associação Nacional dos Serviços Municipais de Saneamento e FNSA – Frente Nacional do Saneamento Ambiental, além dos deputados federais Arnaldo Jardim e Samuel Moreira. O debate foi transmitido ao vivo e pode ser visto AQUI (veja o álbum de fotos). O evento contou com presenças dos diretores nacionais da ABES e dos presidentes das Seções Estaduais. No dia 5 de fevereiro, representantes da Associação Brasileira de Engenharia Sanitária e Ambiental – ABES, Associação Brasileira das Empresas Estaduais de Saneamento – AESBE, Associação Nacional dos Serviços Municipais de Saneamento – ASSEMAE e Associação Brasileira de Agências de Regulação – ABAR – entregaram ao secretário Nacional de Saneamento Ambiental, Jônathas de Castro, um documento conjunto com propostas de alterações à MP 868 (leia aqui este documento).  Além disso, a ABES apresentou ainda um documento com propostas da entidade de emendas à MP 858 (veja aqui). 

O debate desta quinta foi coordenado pelo diretor nacional da ABES, Alceu Guérios Bittencourt. O engenheiro também realizou a abertura do evento. “Sabemos que existem muitos gargalos [no saneamento] e que não existem atalhos. O setor é bastante complexo”, destacou Alceu. E lembrou que é bastante oportuna a discussão do marco regulatório do setor e o papel da ABES neste cenário. “Na condição de ser uma entidade que reúne profissionais de todo o setor, a ABES se sente responsável em contribuir para a discussão congregando os segmentos. Temos a tradição de buscar atuar em parceria com as entidades. Agradecemos a presença das autoridades que aqui vieram. Os interesses são legítimos e naturais”, disse.

Carlos Motta Nunes, especialista em Recursos Hídricos da ANA, abordou o papel da agência com o novo marco legal do saneamento. “Eventos como este são importantes para dar uma nivelada no entendimento e ouvir diferentes opiniões sobre a questão da MP 868”, ressaltou. “A MP 868 é bastante controversa, polêmica, mas só vamos conseguir chegar a um acordo no Congresso a partir do momento em que todas as partes se falem. Então, esse debate promove o início do conserto da MP. Tem que avançar de alguma forma e não deixar morrer”, concluiu Carlos Motta.

O chefe de gabinete da Secretaria Nacional de Saneamento Ambiental do Ministério do Desenvolvimento Regional, Geraldo Correa, falou acerca do tema “Os aspectos da MP 868”. Ao final, ele comentou sobre o evento. “O setor precisa de debates e soluções. Nosso debate foi proveitoso e produtivo. Ouvimos algumas opiniões contraditórias, contrárias, a favor e as que ajudam a construir um texto em que o foco seja o usuário e a população. Mostrou que todos estão interessados em melhorar, expandir e garantir a qualidade do serviço de saneamento”, disse após agradecer o convite da ABES, “uma oportunidade de expor ideias”.

Percy Soares Neto, diretor de Relações Institucionais da ABCON, que falou sobre a melhoria na segurança jurídica para operação dos serviços de saneamento, comentou sobre a importância do debate. “A ABES acertou na realização do evento e deu oportunidade para todos os lados falarem e darem opinião sobre a MP 868. É um tipo de debate que enriquece a discussão do setor de saneamento com ou sem MP. É sempre bom encontrar todos os atores do setor que sempre têm ideias novas, a gente sempre sai diferente em experiências como esta”, salientou.

Para Ubiratan Pereira, secretário executivo da AESBE que abordou o tema “O impacto da pulverização da prestação de serviços nas empresas estaduais”, o evento foi de extrema importância para o debate do Marco Regulatório do Saneamento. “Estamos em vias de uma aprovação ou não. O debate enriqueceu a opinião de todos os entes que elaboraram essa participação. Agradeço pelo convite”, disse ele, que em sua aprsentaçã0 falou sobre o impacto da pulverização da prestação de serviços nas empresas estaduais.

Representando a ABAR, o diretor da ARSESP, Paulo Lencioni Góes, discorreu sobre o novo modelo de regulação para o saneamento. Para ele, o debate foi “riquíssimo e de altíssimo nível para construir consensos em torno do assunto. O tema do saneamento é de grande relevância, a iniciativa da ABAR vai ao encontro dessa necessidade que é de alguma maneira nesse processo tão atropelado que tem sido a discussão do aperfeiçoamento do marco legal. A oportunidade de obter ideias, propostas para de alguma maneira proporcionar legitimidade ao eventual resultado desse processo”, afirmou.

Edson Aparecido da Silva, da Frente Nacional do Saneamento Ambiental, abordou o tema “O impacto social com o novo marco legal do saneamento”. Ele parabenizou a ABES pela iniciativa e frisou que o debate foi rico e democrático. “As entidades puderam manifestar a sua opinião sobre a MP 868. Os grandes consensos são que a MP não irá solucionar os problemas, o melhor instrumento para caminhar neste sentido não seria uma MP e sim um Projeto de Lei. É fundamental que o debate prossiga para derrotar o artigo 10C e 8D, que desestruturam o setor”, enfatizou.

O deputado federal Samuel Moreira, que integrou a mesa de debates, deixou a sua impressão sobre o evento. “Gostei muito! Foi excelente e produtivo. Reuniu uma diversidade de opiniões e para nós, da Comissão, é bom ouvir todas elas. Quero cumprimentar à ABES pelo trabalho e o encontro”, disse. O deputado Arnaldo Jardim não pode ficar até o final do encontro, mas deixou a coordenador da mesa uma clara mensagem de apoio à ABES e às outras entidades que apresentaram propostas de alteração à MP.  “Estou junto com vocês”.

O presidente da Assemae, Aparecido Hojaij, apresentou uma palestra sobre “a titularidade municipal dos serviços está sendo afetada? “Entendemos que a MP 868 representa a saída do Governo Federal do financiamento do setor de saneamento, o que pode aumentar o desemprego no setor e causar grande crise dentro das companhias”, ressaltou.

O presidente nacional da ABES, Roberval Tavares de Souza, questionou em sua apresentação se a universalização do saneamento será solucionada no Brasil. “O saneamento no nosso pais está ruim”, disse enfático. “Se não admitirmos isso, não conseguiremos avançar. Mais de 30 milhões de brasileiros não têm acesso à agua potável. E mais de 120 milhões não têm serviços completos de esgoto – coleta e tratamento. A MP vai melhorar isso?”, perguntou, para responder em seguida. “Com o modelo atual [do marco regulatório], segundo cálculos, a universalização do saneamento acontecerá em 2064. Com a Medida Provisória, não vai universalizar”, afirmou Roberval.
