Promovido e pela Câmara Temática de Tratamento de Esgotos da ABES, em parceria com a ABES Seção Minas Gerais (ABES-MG) e com o Instituto Nacional de Ciência e Tecnologia em Estações Sustentáveis de Tratamento de Esgoto (INCT ETEs Sustentáveis), o encontro ocorrerá na Universidade Federal de Minas Gerais. Membros da CT Tratamento de Esgoto, que é composta pelos coordenadores Edgard Faust Filho, Marcelo Miki (adjunto), Gustavo Rafael Collere Possetti e Mário Augusto Loureiro Leite, falam sobre o tema. ABES Notícias – Qual a importância da realização deste seminário?
CT Tratamento de Esgoto – O uso agrícola de lodo de esgoto é uma destinação ambientalmente sustentável, pois promove a reciclagem de nutrientes e matéria orgânica presentes, beneficiando o solo e consequentemente o cultivo de plantas. Além disso, diminui a pressão sobre aterros sanitários, atendendo as prerrogativas da Política Nacional de Resíduos Sólidos (PNRS), Lei 12.305/10. É uma alternativa mundialmente consolidada, cuja utilização no Brasil está limitada a poucos estados.
Um dos principais motivos da pouca adesão a essa alternativa no Brasil é, a nosso ver, a ocorrência de critérios e procedimentos técnicos um tanto que exagerados da Resolução Conama – RC 375/06, que normatiza o uso agrícola de lodo de esgoto no Brasil. Entendemos também que alguns conceitos e critérios da RC 375/06 ficaram conflitantes com os princípios publicados posteriormente pela PNRS, no que tange à definição de materiais possíveis de serem reciclados e reutilizados.
Na RC 375/06 trata-se o lodo Classe A, ou seja, aquele no qual não houve detecção de patógenos, como um mero resíduo, mesmo após beneficiado e com alto padrão de qualidade, ou seja, não possui o entendimento de que esse material é um produto reciclado, e como tal, poderia ter destinação controlada e adequada, de forma benéfica ao meio ambiente e útil para a sociedade. Como o lodo é tratado como um resíduo, sua disposição no solo é condicionada a períodos de descanso e a um extensivo monitoramento das áreas de cultivo, durante longos períodos, que por si só inibe a prática, até mesmo para estações de grande porte. Percebe-se, de forma geral, uma ineficácia dessa resolução, ao tratar de forma limitada o benefício que esse material pode oferecer para a sociedade e ao meio ambiente.
Já para o Lodo Classe B, em que há concentrações limites de indicadores patogênicos, a RC 375/06 baniu seu uso após 5 anos de sua publicação. Nos EUA através da Norma US EPA Part 503, de onde surgiram estes conceitos de Classe, há o entendimento de que o Uso do Lodo Classe A é equivalente ao Uso do Lodo Classe B, quando são adotadas restrições locais e práticas de gestão.
Dessa forma, o seminário é uma importante oportunidade de debate sobre o tema. O objetivo do seminário é reunir universidades, instituições de pesquisas, organizações não governamentais, prestadores de serviços de saneamento, órgãos ambientais, usuários e outros diferentes atores da cadeia do saneamento, para discutir o uso benéfico de lodo em solos, de modo a subsidiar a construção de uma regulamentação que propicie de forma sustentável esta prática no Brasil.
ABES Notícias – Um dos objetivos do seminário é discutir uma proposta de revisão da resolução Conama 375/06 para que a prática possa ser viável e segura. Qual é a situação do Brasil em relação à regulamentação do uso de lodo de esgoto em solos?
CT Tratamento de Esgoto – Após mais de 10 anos da publicação da RC 375/06, somente o Estado do Paraná, através da SANEPAR e com a devida autorização do Órgão Ambiental – IAP, pratica o uso de lodo na agricultura. Em Brasília e Goiás, os prestadores de serviços de saneamento também implementaram algumas experiências práticas de uso de lodo em solos, porém, para situações pontuais e com aberturas legais locais, ou seja, para usos muito específicos ou por meio de projetos de recuperação de solos autorizados pelos órgãos ambientais. Já no Estado de São Paulo, vem sendo seguida em algumas unidades a via de produto agrícola, através da produção de fertilizante ou condicionador de solo, seguindo as normatizações do Ministério de Agricultura, Pecuária e Abastecimento – MAPA.
Além da RC 375/06 ser uma resolução que, de forma geral, inibiu o uso agrícola do lodo, a redação da RC 375/06 previa sua revisão após sete anos de sua publicação, já expirado há bastante tempo, contribuindo assim para a motivação deste seminário.
Nos últimos anos, muito se desenvolveu em pesquisa, desenvolvimento e inovação tecnológica na temática do uso benéfico do lodo de ETE. Isso permite que hoje sejam utilizadas técnicas mais eficazes de controle e monitoramento, e mais seguras para disposição, do que àquelas previstas na RC 375/06.
Vale ressaltar também que as demandas e alternativas de uso são diferentes regionalmente, a exemplo das soluções obtidas em Brasília e em Goiás. Portanto, a revisão dessa resolução é fundamental para fomentar e dar segurança jurídica para os diversos usos benéficos do lodo de ETE no solo.
ABES Notícias – Quais são os principais entraves nesse processo regulatório?
CT Tratamento de Esgoto – Um dos principais entraves é de cunho legal. De forma mais abrangente, por exemplo, as definições da RC 375/06 para o lodo beneficiado até atingir uma qualidade que permita sua disposição segura no solo, divergem quanto à qualificação e usos possíveis da PNRS e inclusive sobre outras leis mais recentes. Dentro desse conflito de definições, residem ainda outros, como os princípios que regem a PNRS. A RC 375/06 tem como objetivo principal definir uma qualidade mínima a ser alcançada por esse lodo após processamento, para que sua disposição em solo para uso agrícola seja segura. Porém, adentra em alguns aspectos que na sua época não eram tratados em outras leis, correndo o riso de se tornar obsoleta e conflituosa com a visão atual socioambiental, materializada nas leis atuais. Além disso, quando a RC 375/06 entrou em vigor, foi previsto em seu texto a necessidade de revisões, não apenas pelo caráter contínuo dos avanços tecnológicos, mas também por conta dos avanços legais na legislação ambiental brasileira, em sintonia com as necessidades e a busca contínua pela sustentabilidade, de forma que outras leis relacionadas à gestão de resíduos sólidos foram sendo criadas, assim como aquelas que tratam de contaminação de solo e subsolo. Além dessas fontes, normas técnicas foram sendo aprimoradas, passando a ser a referência para assuntos correlatos aos tratados pela RC 375/06.
Já do ponto de vista mais prático, foi estabelecido o banimento do denominado lodo Classe B após 5 anos da publicação da RC 375/06, sem as devidas discussões periódica previstas na própria Lei. Este tipo de exigência inibiu em parte o uso agrícola de Lodo de ETE, adotando o aterro sanitário como alternativa de disposição final por questões econômicas e de logística operacional.
Por outro lado, em algumas instalações com melhor aparelhamento, partiu-se para a implantação de processos mais sofisticados como por exemplo, compostagem ou estabilização alcalina. Mas mesmo adotando estes processos que produzem o Lodo Classe A, há uma série de exigências logísticas que não ocorrem em países desenvolvidos, que tornam esta prática não atrativa para as empresas operadoras de saneamento.
Um ponto que entendemos ser bem controverso é o entendimento pela agência ambiental reguladora da necessidade de um licenciamento ambiental específico para cada área de aplicação agrícola.
E por último, cabe citar, ainda, que certas análises laboratoriais exigidas para a aplicação do lodo de esgoto, como os vírus entéricos, não são facilmente disponíveis em laboratórios no Brasil. Mas o que se argumenta não é a questão do custo ou acesso laboratorial e sim a real necessidade de análise de certos parâmetros, sendo que para muitos deles sequer há limites de concentração e foram inseridos somente para monitoramento.
ABES Notícias – É possível citar experiências do Brasil na utilização do lodo para fertilização e recuperação de solos?
CT Tratamento de Esgoto – Sim, por quase uma década a SABESP fez uso agrícola de lodo do tipo CLASSE B antes da publicação da RC 375/06 através da ETE de Franca. A CAESB realizou um trabalho de recuperação de áreas degradadas. No Estado do Paraná, em 1998 iniciou-se o uso agrícola de lodo de esgoto em escala piloto na Região Metropolitana de Curitiba, como resultado do Programa Interdisciplinar de Pesquisa, desenvolvido a partir de 1988. Desde 2002, a alternativa passou a ser realizado também pelas ETEs dessa Região e na de Foz do Iguaçu com respaldo do órgão ambiental do estado por meio de autorização ambiental. Em 2007, após a vigência da RC 375/06 promoveu-se a ampliação do uso agrícola de lodo de esgoto para o restante do estado. Atualmente, cerca de 30 mil toneladas de lodo higienizado são destinadas para aplicação em solos agrícolas, sem nenhum registro de contaminação ambiental, ou problemas associados à saúde pública nessas áreas de aplicação.
Em um levantamento bibliográfico recente, foram identificados mais de 150 trabalhos científicos, alguns que vêm acompanhando a condição do solo após mais de 13 anos de disposição; da eficiência como fertilizante e na recuperação de solos degradados; entre outros, e que atestam a segurança e a eficiência do uso desse material no solo e culturas brasileiras. Não obstante a isso, a literatura internacional é farta em publicações sobre esse assunto.
ABES Notícias – Ainda neste sentido, quais são os riscos e as vantagens desta prática?
CT Tratamento de Esgoto – Os potenciais riscos desta prática estão associados ao tipo de uso e a exposição – como para qualquer produto, inclusive de origem natural. Ou seja, em uma análise de risco, entram variáveis que, desde que conhecidas, são controláveis. O maior risco está, portanto, no uso indevido do material. O lodo Classe B, por exemplo, que possui certa presença de patógenos, foi utilizado por mais de uma década na Região de Franca e não se tem registros de nenhum caso de contaminação ambiental ou dano à saúde pública.
Como vantagens, pode-se citar a reciclagem de elementos benéficos presentes no lodo para o solo, propiciando condições favoráveis para o desenvolvimento de plantas e a melhoria das características físicas do solo, o sequestro de carbono, a diminuição da pressão sobre aterros sanitários, o acesso da sociedade a um material de altíssima qualidade, para quem as empresas de saneamento têm ofertado geralmente sem custos.
ABES Notícias – Na sua visão, como as experiências internacionais podem contribuir para as questões relacionadas ao tema no contexto brasileiro?
CT Tratamento de Esgoto – As experiências internacionais podem contribuir para a formação de uma massa crítica de técnicos que sejam capazes de absorver os fundamentos técnicos do estado da arte mundial, conhecer novas tecnologias e experiências associadas ao uso benéfico do lodo no solo e adaptá-las para a realidade local.
O uso do lodo na agricultura em outros países já é praticado há décadas, por exemplo nos países europeus, onde a pressão por área é altíssima. Na Europa, a prioridade do estado é justamente que as empresas de saneamento procurem alternativas econômico e socioambientalmente viáveis, sendo a disposição desse tipo de material em aterros a última alternativa a ser considerada, em alguns casos sendo até proibida. É bom assinalar que os países da união europeia estão sujeitos a leis comuns, e possuem normas locais específicas.
ABES Notícias – Em relação aos aspectos técnicos e tecnológicos do tema, quais são os principais desafios do país?
CT Tratamento de Esgoto – Muitas vezes uma das barreiras da tecnologia é justamente a existência de regulamentações que acabam inibindo a introdução de inovações tecnológicas.
Sendo assim, o maior desafio hoje é o risco legal e não a tecnologia. Em uma situação onde há conflitos de normas, como as já apresentadas, conflitos com leis de temáticas correlatas e até mesmo políticas públicas, e de outro lado há um engessamento de uma lei que avança sobre a definição inclusive de tecnologias, que a rigor passam por alterações contínuas e, inclusive melhorias de interesse do próprio legislador e da instituição de meio ambiente, torna-se totalmente arriscado para o empresário ou para as empresas de saneamento investir milhões de reais em tecnologias que podem não ter sua permissão de uso e produção permitidas, por dificuldades como encontrar laboratórios acreditados que realizem 100% das análises exigidas pela RC 375/06.

CT Tratamento de Esgoto – O papel da ABES é trazer à tona a discussão técnica com diferentes atores da cadeia de saneamento, como por exemplo, as empresas operadoras, a academia e os órgãos reguladores, procurando fazer um debate crítico dos problemas ambientais num contexto que considere as diferenças regionais.
O objetivo é promover o debate para a construção de uma proposta de revisão da RC 375/06 de forma que ela apresente critérios e procedimentos compatíveis com o desenvolvimento técnico-científico e com a realidade brasileira.
