“É fundamental que estes profissionais incorporem cada vez mais no seu dia a dia de captação de conhecimento, habilidades e técnicas, o aperfeiçoamento de práticas de gestão dos serviços e de relacionamento com a sociedade”, ressalta Álvaro Menezes, que ministrará, nesta quarta-feira, dia 17 de janeiro, às 16h, o webinar gratuito “Regulação nos serviços de saneamento. Como efetivar?”.

ABES Notícias – Qual é a situação da regulação no Brasil hoje?
Álvaro José Menezes da Costa – Segundo dados da ABAR, há aproximadamente 50 agências que atuam no setor de saneamento. Aproximadamente, porque há agências que existem, mas ainda não atuam objetivamente como reguladoras no setor. A existência delas tem relação direta com a existência dos PMSB – Planos Municipais de Saneamento Básico, ou seja, a julgar pelo último levantamento do MCidades, apenas 30% dos municípios possuem PMSB e consequentemente podem estar sendo regulados por algum tipo de agência estadual, municipal ou intermunicipal.
Esta situação que é quantitativa, se agrava quando se analisa qualitativamente a atuação das agências no Brasil. Sempre é importante alertar, no caso do saneamento principalmente, para a importância da visão regional que deve ser levada em conta para avaliar o desempenho da regulação no país. Muitas agências são vistas por prefeituras como fonte de receita, outras como fiscais da operação dos serviços e outras como meras ouvidorias.
Para avaliar a regulação hoje, necessário se faz procurar saber se o papel das agências reguladoras como praticantes de princípios da teoria econômica, órgãos públicos governamentais fiscalizadores da gestão dos serviços e controladores do que estabelecem os PMSB e os contratos de prestação de serviços com operadores públicos ou privados, são conhecidos. Conhecidos pela sociedade, pelos operadores e pelas próprias agências.
De fato, a regulação no Brasil tem um longo caminho a percorrer, notadamente nos Estados do Norte e Nordeste, porque há carências fundamentais relacionadas a desinformação e baixa capacitação para utilizar a regulação como promotora das funções básicas de normatização, de controle e de fiscalização. Não se pode no entanto deixar de reconhecer que ha agências capacitadas e que houve avanços.
ABES Notícias – Quais são os maiores desafios, neste sentido?
Álvaro José Menezes da Costa – Eles estão associados ao reconhecimento de coisas como:
– Características locais e regionais do Brasil e seus serviços públicos;
– Características locais e relações sociais intrínsecas ao serviço de saneamento;
– Necessidade de fortalecimento dos princípios da lei 11.445/2007 no que se refere ao planejamento, gestão e sustentabilidade dos serviços e seus contratos;
– Capacitação das agências reguladoras estaduais, municipais e intermunicipais para desempenhar atuar com base na teoria econômica, desempenhando as funções de normatização, controle e fiscalização.
– Governos Estaduais e municipais considerarem as agências como órgãos técnicos governamentais respeitando sua autonomia legal;
– Levar a sociedade o conhecimento do papel das agências;- E, o desafio mais atual que é impedir o Governo Temer de altera a lei 11.445/2007 para transformar a ANA numa agência provincial.

Álvaro José Menezes da Costa -A primeira razão tem a ver com as mudanças que a gestão dos serviços de saneamento vem vivenciando nos últimos 10 anos, pelo menos. A entrada mais ativa de operadores privados, a existência de PMSB, a existência das próprias agências reguladoras e a necessidade de universalizar os serviços, exigem que toda a sociedade procure aprender o que é a regulação para poder buscar, entre outras coisas, seus direitos a serviços de qualidade.
A segunda se refere ao fato de que a regulação não é uma atividade que esteja restrita aos limites dos escritórios das agências reguladoras ou dos prestadores de serviços de saneamento sejam eles públicos ou privados. Ela interfere na vida do cidadão e portanto, os técnicos e gestores públicos, mais que ninguém, precisam incluir a regulação em sua pauta de conhecimentos e práticas.
ABES Notícias – Na sua visão, como a qualificação dos profissionais do saneamento pode contribuir para transformar o cenário da regulação no país?
Álvaro José Menezes da Costa – É fundamental que estes profissionais incorporem cada vez mais no seu dia a dia de captação de conhecimento, habilidades e técnicas, o aperfeiçoamento de práticas de gestão dos serviços e de relacionamento com a sociedade. Não se busca tão somente um profissional que seja extremamente técnico – engenheiro, advogado, economista, administrador ou nível médio – mas principalmente um profissional que saiba conjugar de forma comum três verbos: planejar, gerenciar e controlar.
O novo profissional do saneamento precisa enxergar o seu entorno com visão ampla, de modo a visualizar as demandas da sociedade e compreende-las, para que possa atender a todos com as soluções que sejam adequadas e com qualidade. A regulação consegue dar ao profissional esta visão integrada, geral e equilibrada de como devem ser gerenciados os serviços de saneamento.

Álvaro Menezes José da Costa – Estes três novos cursos tratam de questões muito importantes e complementares ao curso de 05 módulos que já está na terceira turma.
Eles são muito importantes porque se referem aos temas:
- a) Remuneração – apresentando os modelos de calculo de BRR – Base de Remuneração Regulatória e dando exemplos reais;
- b) Benchmarking – a respeito das principais técnicas de comparação entre empresas prestadoras de serviços regulados e as metodologias de Benchmarking e Yardstick Competition;
- c) Contabilidade regulatória – instrumento adotado por reguladores para obter informações padronizadas e sistematizadas dos prestadores regulados a fim de melhor exercer as funções de regulação e fiscalização dos serviços.
