Reunião do Conselho das Cidades aprova moções e resoluções contra alterações decretadas

Em reunião do Conselho das Cidades, realizada nesta terça-feira, 27 de junho, no Ministério das Cidades, em Brasília, entidades membros do Conselho apresentaram e aprovaram resoluções e moções contra o decreto 9076, de 07 de junho de 2017, do Governo Federal, que determina a transferência da Conferência do ConCidades de 2017 para 2019, tirando do Conselho e passando para o ministro a sua convocação e também excluindo da Conferência a atribuição de eleger o novo Conselho das Cidades. A ABES é representada no ConCidades por Darci Campani, associado Membro do Conselho Diretor pela seção Rio Grande do Sul da entidade.

De acordo com Campani, o Conselho decidiu em resolução pedir que o Governo revogue o decreto que tira do Conselho a tarefa de convocar a Conferência Nacional das Cidades, principalmente por que o processo já estava no meio de sua realização, pois a etapa municipal, da Conferência, já tinham ocorrido, bem como algumas estaduais, passando este poder para o ministro da Cidades, Bruno Araújo.

Ele explica ainda que o decreto tira da Conferência das Cidades a tarefa de eleger a composição do futuro Conselho, como ocorria desde a sua instalação. E para o atual, extingue seu mandato, sem previsão de prazo para a constituição da nova composição, e que passará, segundo a proposta do Governo, a ser o resultado de uma audiência pública a ser chamada ainda sem data prevista. O decreto também passa a Conferência das Cidades, que estava convocada para junho de 2017, para 2019.

“O governo ficou todo o primeiro semestre sem convocar reuniões do Conselho das Cidades, que deveriam ocorrer a cada 3 meses, com reuniões mensais da executiva”, afirma Campani. “As entidades do Conselho em sua maioria conseguiram chamar uma reunião extraordinária, enquanto os seus membros procuravam articular o cumprimento do Regimento Interno do Conselho, o Governo articulava a redação e publicação do decreto 9076/17.”

Darci Campani informa que com as moções aprovadas por ampla maioria, com o voto contrário apenas dos membros do Governo Federal, no encerramento da reunião, o secretário executivo do Ministério da Cidades, Marco Aurélio de Queiroz Campos, afirmou que o Ministério irá chamar as entidades para conversar e receber propostas para a composição do novo Conselho. “Não abriu negociação para pelo menos manter o Conselho, democraticamente eleito, até pelo menos a consolidação da nova composição, com isto o governo, tratou de não ter um ente legalmente estabelecido com o qual teria que dialogar”, criticou Campani. Salienta ainda que o Governo ao não chamar as reuniões ordinárias do Conselho demonstrou claramente a falta de vontade de negociar”. 

“É importante destacar que a reunião do Conselho decidiu pela realização da Conferência Nacional das Cidades para os dias 8, 9 e 10 de dezembro de 2017, cabendo agora à sociedade civil garantir a realização da Conferência caso o Ministério ignore as deliberações do Conselho”, disse Campani.

“Uma situação concreta é a representação do Conselho das Cidades no Conselho do Fundo Nacional de Habitação de Interesse Social, que precisa aprovar as suas contas, mas teria que renovar seus membros. Mas se o Conselho não possui membros, não teria nem quem indicar”, afirma Campani. “O mesmo acontece com o Grupo de Trabalho de acompanhamento do PLANSAB, que tem de se reunir a cada 3 meses. Sem os membros do Conselho também haverá dificuldade de quórum, ainda mais no momento em que se está abrindo a revisão do Plano”, pontua.

Espera-se, segundo o representante da ABES, que o Ministério Público Federal determine a revogação do decreto, “até por que ele fere a MP 2.220/2001, no seu artigo 10, quando diz que o Regimento Interno do Conselho tem que ser votado pelo Conselho e o decreto muda artigos que estão no regimento interno, que só poderiam ser alterados pelo próprio Conselho”.

Audiência Pública

Nesta quarta-feira, 28 de junho, a Câmara dos Deputados, por meio da Comissão de Desenvolvimento Urbano, promoveu a Audiência Pública com o tema “Gestão Democrática das Cidades” – no âmbito da atuação do Ministério das Cidades.
Darci Campani, representante da ABES no Conselho da Cidades, explica que a grande maioria dos deputados se posicionou pela revogação do decreto. Eles propuseram um decreto legislativo para revogar o decreto do presidente.

Segundo ele, foi apresentada uma proposta para que o Ministério convoque a reunião aprovada pelo Conselho para julho e que durante este mês se façam discussões procurando um parecer que resolva os problemas criados pelo decreto.

Na audiência pública, conforme Campani, ainda foi lembrado que o Senador Romero Jucá, na condição de líder do Governo, aceitou como elemento de negociação para o destrancamento da pauta para a votação da LDO e outros projetos de interesse do Governo, a manutenção da Conferência das Cidades em 2017, conforme se pronunciou o líder da Oposição Dep. Afonso Florence.

Ainda de acordo com ele, na próxima quarta-feira, dia 5 de julho, o Ministro das Cidades realizará uma reunião com os deputados da Comissão para dar seguimento às negociações.
